By using the Website and clicking on 'Create account' when registering, the user expressly accepts that he or she will be bound by the terms and conditions applicable to the services provided by Cubamax, and the privacy terms. These terms and conditions are subject to modification at any time. It is important that the customer reads it every time he is going to process an order. We understand the challenge of being separated from your family and friends. In order to provide a new service to help them stay in touch, Cubamax arises. Providing cell phone recharge services, Nauta account recharges and sending text messages. Cubamax is not responsible for the delivery of 100% of text messages sent to Cuba, as it is a third-party service that is not guaranteed in this way.

REGISTER

In order to benefit from the Cubamax service, the customer has to create an account or use their Google/Facebook profile.

When creating an account, the customer must provide accurate, complete and up-to-date information as requested in the registration form. The client accepts that the information he/she offers is true, accurate and complete and must update said information where appropriate. All personal information, including financial information ('Data') that you provide to us as a member will be treated in accordance with the Privacy Statement accessible by clicking here. If you are under 18 years of age, you must obtain parental/guardian permission before using our services. If you are an employee of a company or other entity or are acting on behalf of a company, you must be authorized to accept the terms and conditions of use on behalf of that employer, company or entity.

Once registered, the customer is fully responsible for all activities that occur under his/her account, including unauthorized use of his/her credit card. The customer must immediately notify any unauthorized use of their account to the following address info@cubamax.com. Each email address and password must be used by a single user and are not transferable.

SERVICES

Cubamax offers its users an innovative platform to send SMS, recharge mobile phone balances and Nauta accounts.

By accepting the terms and conditions and using our services, you represent and warrant that you will not use the service in any way that violates any copyright, intellectual property, or other rights. Violations or possible violations must be immediately reported to the address info@cubamax.com. These services are provided "as is", without any warranty other than what they can provide. Even so, Cubamax will do everything possible to provide users with a satisfactory experience while using our services. All questions, malfunctions, complaints or recommendations must be communicated by email to the address info@cubamax.com or using the Contact Us service available on our Home page.

Cell Phone and Nauta Recharge Service to Cuba.

To send a cell phone recharge to Cuba, you agree to comply with and carry out the provisions of this Section.

You will be asked to enter the mobile phone number to which the chosen amount will be deposited when recharging. It is your responsibility to ensure that you have entered the mobile phone number correctly. You will then be asked to select the amount of money (in the destination currency secured by our providers) with which you wish to credit said mobile phone. The cost of the Recharge will vary depending on the amount you want to send to your friend or family member according to the price denominations that appear on the Website. If the Recharge you send must be received in a currency other than the currency of your credit or debit card, a conversion fee will be applied which will be applied by the banking institution that supports your credit card. The total amount you will be asked to pay will be clearly displayed on the Website before you are asked to confirm your transaction, and proceeding at this point is completely optional. The Recharge is sent immediately to the mobile phone number provided by you after payment authorization. Once the recharge is confirmed by our suppliers, it will be processed upon payment capture. If the requested services cannot be completed, the authorization will be canceled and payment will not be processed.

We will send you a confirmation email containing details of the Recharge sent as soon as the Recharge transaction has been successfully completed. You agree and understand that Cubamax only acts with your authorization to send Recharges and the relevant mobile operator will be solely responsible to you and the recipient of the Recharge for the provision of mobile services related to the Recharge. Once the Recharge is sent to a mobile phone number, it can be used immediately, however, it cannot be returned or removed from your phone. Due to the nature of the Recharge service, you do not have the right to cancel this Agreement and request it back, the Recharge service is not reversible once it has been successfully executed in the destination country.

PAYMENT TRANSACTIONS

Payments are made by credit card or any other means, as specified at https://cubamax.com. Once a recharge is requested, the transaction is authorized, after verifying that there are funds available on the card, the recharge is sent and after receiving confirmation of delivery, Cubamax will proceed to capture the previously authorized funds. If the recharge requested by the client cannot be correctly executed, the prior authorization will be canceled and the client's card will not be processed.

The user will then receive a confirmation via email that the transaction has been successful. Cubamax is not obliged to carry out any type of additional authentication or identity verification other than those that Cubamax considers appropriate and sufficient to protect the security and maintain the proper use of this Website. All debits concluded after successful authentication or identity verification are the sole responsibility of the user. Cubamax will accept liability for the non-execution or defective execution of Recharges made through the Website, subject to your adherence to this Agreement, the correct use of the Website following the instructions of Cubamax, and the absence of any falsehood, fraud or negligence by part of you. Such liability, if it occurs, will be strictly limited to the amount of the Recharge for non-executed or defective transactions.

PROMOTIONS

Regularly, Cubamax will carry out promotions on the Website. These promotions will be subject to additional terms and conditions to this Agreement (including the closing date for any promotion) will be clearly identified on the Website.

USE POLICY

Cubamax is a private company that offers services to people from Cuba. Abusive use of these services for illegal, commercial or fraudulent practices will result in the immediate cancellation of the responsible account. Likewise, Cubamax reserves the right to deny access to its page to any person who has engaged in these practices or any other practice of a criminal nature.

BANK RETURN AND CLAIMS POLICY.

Cubamax will return credits spent for uncompleted services to your bank account when erroneous recharges are sent, after having investigated internally and corroborated with the corresponding provider that the user is right and that it was a system failure. On the other hand, if the service was successfully processed with the information provided by the account owner, Cubamax will not refund said transaction, with the user being the maximum responsible for any error during the process.

In the event of a bank claim against our company, Cubamax reserves the right to disable your access to your account during the period in which the investigation of the facts declared in said bank claim is carried out and once said process is completed Cubamax will contact you. to inform you of the results of said investigation and the particularities of your use of our services from that moment on.

PRIVACY POLICY

Cubamax as part of the services and this agreement will comply with the protection of relevant data related to the user. Once you have entered your personal information: name, address, email and telephone number to our website, these will be subject to the terms of the privacy policy, and except to the extent that such disclosure is necessary by law or pursuant to an agreement or request issued by the Tax Regulator or other competent legal or regulatory authority, shall be accessible only to us, our agents or a company controlled by us and will be processed or used by us for the purposes and in a manner compatible with the performance of our obligation under the Agreement. SERVICE SUSPENSION

Cubamax may terminate this Agreement and abandon the use of the website and/or the services provided by it if a failure or malfunction occurs to any System used in connection with the website. The same procedure will be followed if the security of the System is at risk. Said suspension may be temporary, considering a reasonable period until the System is resolved without incurring any liability towards you.

YOUR CONTRIBUTION

By sending Cubamax any comments, suggestions, ideas or other materials in relation to or through the Website or the services provided, you agree that we may use, reproduce, publish, modify, adapt and transmit said communication free of charge to third parties. and without restriction, without prejudice to the obligations under the Privacy Statement.

SECURITY, MAINTENANCE AND AVAILABILITY

In order to improve our services and provide greater quality to our users Cubamax may for security reasons, maintenance (whether emergency or planned), updates or other reasons interrupt certain or all Customer Services; and/or delay the implementation of any new Services; and/or remove, replace or reissue passwords; and/or change authentication procedures or processes for accessing the Website or Services, although we will do our best to minimize the inconvenience caused.

TERMINATION OF THE AGREEMENT

Cubamax may conclude this Agreement and withdraw the use of this Website and/or the services provided immediately after breach of any of the terms or when there are justified reasons for its termination. In the same way, it will be terminated if there are reasons to believe that any of the services have been provided negligently, illegally or fraudulently on your part or by a third party as a result of your negligence or recklessness. Once the decision is made you will be notified in writing.

This Agreement has no minimum or finite duration and will remain binding on the parties until terminated. We reserve the right to process or cancel any transaction in progress upon termination of this Agreement or suspension or withdrawal of the Services. We are not responsible for any loss you may incur as a result of any transaction not being processed as part of the Services after termination of the Agreement or after any suspension or withdrawal of the Services.

AGREEMENT VARIATIONS

Cubamax reserves the right to modify the Agreement. Such changes will be effective within a business period of fourteen (14) days after notification of such variation has been sent to the user by any of the following means: mail, email or by posting a message on this Website.

You will have every right, upon receipt of notice of any modification to this Agreement, to immediately terminate the Agreement by written notification to info@cubamax.com without prejudice to any rights or obligations that have arisen before the date of termination. including liability for any indebtedness on any account or any other obligation, financial, legal or otherwise arising prior to the date of termination.

INTELLECTUAL PROPERTY

Cubamax owns all rights in any accompanying logos, as well as domain names https://cubamax.com/. Likewise, property rights are attributed to all data, information, Systems or other materials used for the provision of services, with Cubamax or its licensees being the sole owner.

The user must only use them for the purpose of receiving the services as reflected in the Agreement. Any reproduction of the contents of the website in any form without prior consent is prohibited.
